This Privacy Policy describes how PACIFIC GLOBAL PARTNERS LLC ("Kanuda," "we," "us," or "our") collects, uses, and discloses Personal Information when you visit kanudausa.com (the "Site"), make a purchase, or otherwise interact with us. This Policy applies to all visitors, customers, and users of the Site.
By using the Site, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Site.

2. Personal Information We Collect
When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual as "Personal Information."
2.1 Device and Usage Information
- Purpose of collection: to load the Site accurately for you, to perform analytics on Site usage, to optimize the Site, to detect fraud, and to deliver relevant advertising.
- Source of collection: collected automatically when you access the Site through cookies, log files, web beacons, tags, pixels, and similar technologies.
- Personal Information collected: IP address, device identifiers, browser type and version, operating system, time zone, referring URL, pages viewed, products viewed, search terms, clickstream data, session recordings, and how you interact with the Site.
2.2 Order and Account Information
- Purpose of collection: to fulfill our contract with you, including processing payment, arranging shipping, providing invoices and order confirmations, communicating with you about your order, screening for potential risk or fraud, and (where you have consented) providing marketing communications.
- Source of collection: collected directly from you when you place an order, create an account, or interact with our services.
- Personal Information collected: name, billing address, shipping address, email address, phone number, payment information (including payment card details processed by our payment processors), purchase history, and account credentials.
2.3 Customer Support Information
- Purpose of collection: to respond to your inquiries and provide customer service.
- Source of collection: collected from you when you contact us by email, chat, social media, SMS, or other channels.
- Personal Information collected: name, email address, phone number, order details, content of your communications, and any other information you choose to provide.
2.4 Marketing and Communications Information
- Purpose of collection: to send you marketing emails, SMS messages, and product updates where you have provided consent.
- Source of collection: collected from you when you subscribe to our email or SMS lists, enter a giveaway, or otherwise opt in.
- Personal Information collected: email address, phone number, name, marketing preferences, engagement history (opens, clicks, etc.).
2.5 Reviews and User-Generated Content
- Purpose of collection: to display product reviews and manage affiliate relationships.
- Source of collection: collected from you and from third-party platforms you use to interact with us (e.g., review platforms, social media).
- Personal Information collected: name, display name, email, profile image, review content, photos or videos you submit, and social media handles.
2.6 Sensitive Information
We do not knowingly collect Social Security numbers, driver's license numbers, precise geolocation data, account login credentials for non-Kanuda accounts, genetic data, or biometric identifiers. If you choose to share sleep-preference or product-fit information through our product quiz, we treat that information as standard Personal Information used to recommend products.
3. How We Use Personal Information
We use Personal Information for the following purposes:
- Providing and operating the Site, including processing transactions and fulfilling orders;
- Communicating with you about orders, accounts, and customer service inquiries;
- Sending marketing emails and SMS messages where permitted by law and your preferences;
- Personalizing your experience, including product recommendations through our product quiz;
- Conducting analytics and improving the Site and our products;
- Delivering targeted advertising on third-party platforms (see Section 5);
- Detecting, preventing, and responding to fraud, abuse, security, or legal issues;
- Complying with our legal obligations and enforcing our terms.
4. How We Share Personal Information
We share Personal Information with third-party service providers ("processors") who help us operate the Site and our business. These providers are bound by contract to use Personal Information only for the purposes for which we engage them. Categories of recipients and the services they support are summarized below.
4.1 E-Commerce Platform and Payments

4.4 Advertising and Audience Measurement
We use the following advertising and measurement partners. These partners may receive information about your interactions with the Site (including device identifiers, IP address, hashed email or phone, and conversion events) and may use that information to build audiences, measure ad performance, and serve targeted advertising on their platforms and across the web. As described in Section 7, some of this sharing is considered a "sale" or "sharing" of Personal Information under certain U.S. state privacy laws.

4.7 Corporate Affiliates
We may share Personal Information within our corporate family of companies that are related by common ownership or control (including our parent company and affiliated brands) to support business operations, customer service, and the services we provide to you.
4.8 Legal and Safety
We may disclose Personal Information to comply with applicable laws, regulations, court orders, subpoenas, or other lawful requests; to enforce our Terms of Service; to protect our rights, property, or safety, or the rights, property, or safety of others; or in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets.
5. Targeted Advertising and Cookies
We use cookies, pixels, SDKs, and similar technologies ("tracking technologies") on the Site to deliver targeted advertising, measure ad performance, and personalize your experience. Some of these technologies are operated by third parties listed in Section 4.4.
Where required by law, we obtain your consent before deploying non-essential tracking technologies. You can manage your cookie preferences at any time through the cookie banner on the Site or, where applicable, through the "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" link in our Site footer.

5.3 Global Privacy Control (GPC)
We honor the Global Privacy Control (GPC) browser signal as a valid opt-out of "sale" and "sharing" of Personal Information for purposes of cross-context behavioral advertising, where required by applicable law (including the CCPA/CPRA and the privacy laws of Colorado and Connecticut). 5.4 Do Not Track
Because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not currently alter our data collection or usage practices in response to such signals (other than the GPC signal described above).
6. Data Retention
We retain Personal Information for as long as necessary to provide our services, comply with our legal obligations (including tax, accounting, and warranty obligations), resolve disputes, and enforce our agreements. When Personal Information is no longer needed, we will delete, anonymize, or de-identify it in accordance with our retention practices and applicable law. You may request deletion of your Personal Information as described in Sections 7 and 8.
7. Your U.S. State Privacy Rights
If you are a resident of a U.S. state that provides consumer privacy rights — including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states with comparable laws — you may have some or all of the following rights, subject to verification and applicable exceptions:
- Right to know / access: the right to request the categories and specific pieces of Personal Information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclose Personal Information.
- Right to delete: the right to request deletion of Personal Information we have collected from you, subject to certain exceptions.
- Right to correct: the right to request correction of inaccurate Personal Information.
- Right to portability: the right to receive a copy of your Personal Information in a portable format.
- Right to opt out of sale or sharing: the right to opt out of the "sale" of Personal Information and the "sharing" of Personal Information for cross-context behavioral advertising.
- Right to opt out of targeted advertising: the right to opt out of targeted advertising based on Personal Information.
- Right to opt out of profiling: the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects (we do not currently engage in such profiling).
- Right to limit use of sensitive Personal Information: the right to limit our use or disclosure of sensitive Personal Information, where applicable (we do not currently use sensitive Personal Information for purposes beyond those permitted by law).
- Right to non-discrimination: the right not to receive discriminatory treatment for exercising your privacy rights.
- Right to appeal: if we deny your request, you may have the right to appeal our decision. To appeal, reply to our decision email or contact us at hello@kanudausa.com with the subject "Privacy Appeal."
7.1 "Sale" and "Sharing" Disclosures
In the preceding twelve (12) months, we have "sold" or "shared" the following categories of Personal Information, as those terms are defined under the California Consumer Privacy Act (as amended by the CPRA) and similar U.S. state laws, to the categories of third parties described in Sections 4.4 and 4.5:
- Identifiers (e.g., name, email, hashed email, phone number, IP address, device identifiers, cookie IDs);
- Commercial information (e.g., products viewed or purchased);
- Internet or other electronic network activity (e.g., browsing and interaction information);
- Inferences drawn from the above (e.g., audience segments and purchase propensity).
These disclosures are made to advertising partners, analytics providers, and audience-building services for the purposes of cross-context behavioral advertising and measurement. We do not knowingly sell or share Personal Information of consumers under 16 years of age.
7.2 How to Exercise Your Rights
To exercise any of these rights, you may:
- Email us at hello@kanudausa.com with the subject line "Privacy Request";
- Use the "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" link in the Site footer (for opt-out requests); or
- Send a written request to the mailing address in Section 1.
We will need to verify your identity before processing your request, which may include confirming information such as your name, email address, and recent order details. You may also designate an authorized agent to submit a request on your behalf; we will require written proof of authorization.
7.3 Notice of Financial Incentive
We offer programs that may be considered "financial incentives" under the California Consumer Privacy Act (as amended by the CPRA) and similar U.S. state privacy laws. These programs provide certain benefits to consumers in exchange for the collection, retention, or use of their Personal Information. We currently offer the following financial incentive programs:
- Email subscription welcome offer: a one-time discount on your first order in exchange for subscribing to our marketing emails.
- Referral program: rewards for referring new customers to Kanuda. Both the referring customer and the referred friend may receive a discount or other benefit when a qualifying purchase is made.
Material terms of these programs. To participate, you provide Personal Information such as your name, email address, and (for referrals) referral activity. The categories of Personal Information collected through these programs are described in Section 2 of this Privacy Policy. Participation is voluntary, you may withdraw at any time by following the unsubscribe instructions in each communication or by contacting us at hello@kanudausa.com, and withdrawal will end your participation in the program but will not affect benefits already earned.
How we calculate the value of your Personal Information. We have calculated, in good faith, that the value of the Personal Information collected through these programs is reasonably related to the value of the offered benefits. This estimate considers the costs of operating the programs, the expected revenue from participating customers, and the cost of the discounts we provide. We believe the price differences resulting from these programs are reasonably related to the value of your Personal Information to our business.
You are not required to participate in any of these programs, and you may purchase from us without enrolling. If you choose to enroll, you may opt out at any time as described above.
8. Your Rights in the EEA, UK, and Switzerland
If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation (GDPR) and equivalent UK and Swiss laws, including the right to access, correct, delete, restrict, or object to our processing of your Personal Information, and the right to data portability. You also have the right to withdraw consent at any time where processing is based on consent, and the right to lodge a complaint with your local data protection authority.
8.1 Legal Bases for Processing
Where the GDPR applies, we process your Personal Information on the following legal bases:
- Performance of a contract with you (e.g., to fulfill your order);
- Your consent (e.g., for marketing communications and non-essential cookies), which you may withdraw at any time;
- Compliance with our legal obligations;
- Our legitimate interests (e.g., fraud prevention, service improvement, and direct marketing of similar products), where those interests are not overridden by your rights and freedoms.
8.2 International Transfers
Personal Information collected from individuals in the EEA, UK, or Switzerland is transferred to and stored in the United States and other countries that may not provide the same level of data protection as your home jurisdiction. Where required, we rely on the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum) as the legal mechanism for these transfers. 9. Automated Decision-Making
We do not engage in fully automated decision-making that produces legal or similarly significant effects on you. Our payment processors and fraud prevention providers (including Shopify) may use limited automated decision-making to detect and prevent fraud, such as temporary blocking of IP addresses or payment cards associated with suspicious activity.
10. Children's Privacy
The Site is not directed to children under 13 years of age (or under 16 in certain jurisdictions), and we do not knowingly collect Personal Information from children. We do not knowingly sell or share Personal Information of consumers under 16 years of age without the affirmative authorization required by law. If you believe a child has provided us with Personal Information, please contact us at hello@kanudausa.com and we will take steps to delete the information.
11. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect Personal Information. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
12. Cookies
A cookie is a small amount of information that is downloaded to your computer or device when you visit our Site. We use cookies and similar technologies to operate the Site, remember your preferences, analyze Site usage, and deliver advertising. The tables below describe the categories of cookies we use. Cookies marked as "session" last only for the duration of your browsing session; "persistent" cookies remain on your device until they expire or are deleted.

12.3 Advertising and Third-Party Cookies
Third-party cookies, pixels, SDKs, and similar tracking technologies (including those operated by Meta, Google Ads and Google Analytics 4 (via Simprosys Google Shopping Feed), Microsoft Advertising (Bing), TikTok, Pinterest, Klaviyo, TripleWhale, Microsoft Clarity, ShareASale, Okendo, Octane AI, Veeform, and Selleasy) may also be set on the Site. Their use is governed by the privacy policies of those third parties. You can manage your cookie preferences through the cookie banner on the Site or by using the opt-out mechanisms described in Section 5.
12.4 Managing Cookies
Most browsers automatically accept cookies, but you can choose whether to accept them through your browser settings. Removing or blocking cookies may impact your user experience, and parts of the Site may no longer function correctly. For more information about managing cookies, visit allaboutcookies.org.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, our services, applicable law, or for other operational or regulatory reasons. We will post the updated Privacy Policy on this page and update the "Last updated" date above. Where required by law, we will provide additional notice or obtain your consent.

If you would like to make a complaint about our privacy practices, please contact us using the information in Section 1. If you are located in the EEA, UK, or Switzerland, you also have the right to lodge a complaint with your local data protection authority.
